Legal and Ethical Aspects of Supervision
Featured Speaker:
Stephen H. Behnke, J.D., Ph.D.
Program Description
This workshop will provide an overview of the legal and ethical aspects of
supervision. The workshop will address how the supervisory relationship is
similar to yet distinct from consultative and therapeutic relationships, and will
explore the ethical significance of these similarities and differences. The
workshop will examine ways for psychologists to minimize their exposure to
legal and ethical liability when supervising, and will address Rhode Island state
law relevant to conducting legally and ethically appropriate supervision. The
workshop will use case vignettes to illustrate how concepts presented in the
workshop are put into practice.

Objectives
Participants will:
- Grasp concepts central to conducting an ethically and legally
appropriate supervisory relationship based upon core texts that derive
from state laws, ethics codes, and professional association guidelines.
- Understand a process for ethical decision-making in the supervisory
context, which includes distinguishing the supervisory relationship
from consultative and therapeutic relationships.
- Apply this process of ethical decision-making to specific topic areas
likely to arise in the supervisory relationship.
- Discover ways to minimize exposure to legal and ethical liability when
conducting supervision.
The Speaker
Dr. S tephen H. Behnke received his J.D. from Yale Law School and his Ph.D. in
clinical psychology from the University of Michigan. In 1996, Dr. Behnke was
made chief psychologist of the Day Hospital Unit at the Massachusetts Mental
Health Center, a position he held until 1998, when he was named a faculty fellow
in Harvard University's program in Ethics and the Professions. After completing
this fellowship, Dr. Behnke directed a program in research integrity in the Division
of Medical Ethics at Harvard Medical School. In November 2000, Dr. Behnke
assumed the position of Director of Ethics at the American Psychological
Association. He holds an appointment in the Department of Psychiatry at Harvard
Medical School.
Dr. Behnke’s research interests focus on issues at the
convergence of law, ethics, and psychology. He has written on multiple
personality disorder and the insanity defense, on issues involving competence
and informed consent to treatment and research, on forced treatment of the
severely mentally ill, and on state laws relevant to the work of mental health practitioners.
